Avoiding Prison through Damage
Reparation - an Ausgleich e.V. pilot project
To all adult remand prisoners at the Stadelheim Detention Centre:
The association
Ausgleich München e.V. was founded in Munich in 1998. Its purpose is to
shorten or entirely eliminate prison sentences by reparation of financial
damage. The interests of the victims are also taken into account here.
Conditions for
conducting mediation proceedings:
- Prosecutor's office of Munich I or Munich II Regional Court
must have jurisdiction over the case.
- Willingness to mediate on the part of both the accused and the
victim.
- May not be a minor offence.
- Admission of damage by the perpetrator or where facts in the
case are largely clarified
Chances:
In case of successful
mediation, the accused stands a realistic chance that the court will mitigate
the sentence or, in certain cases, waive sentencing (Section 46 1 of the
German Penal Code). In case of early reparations, the chances of release
from pretrial remand detention are also enhanced.

Experienced lawyers.
Costs for involvement of
Ausgleich München e.V.:
The mediation lawyer
appointed is paid for by the association.
Procedure:
Ask your lawyer to contact the association. If you do not yet have a
defence lawyer, you can contact us yourself with concrete proposals for
reparations, preferably by including precise information on the injured
party and its address. We then check to see if the case has possibilities.
